The ACCC proposes to grant re-authorisation to the Australian Dental Association Inc (ADA) to continue to make and give effect to contracts, arrangements and understandings between 2 or more dentists and/or dental specialists on the fees to be charged for dental services provided within a practice, where the parties operate in a ‘shared practice’ and at least one party is a member of ADA.

The ACCC proposes to grant re-authorisation for a period of 12 months. The ACCC has also granted interim authorisation for existing arrangements to continue, while the ACCC considers the application.

The ACCC is now seeking submissions in response to the draft determination by 28 April 2023, before making its final decision. Further details about the application and how to make a submission are available on the ACCC’s public register.
