This fact sheet provides an overview of the business-to-business unfair contract terms law, which prohibits terms which are considered unfair in small business standard form contracts.
This fact sheet reflects the unfair contract term laws at a point in time and does not reflect unfair contract term protections for insurance contracts which commenced in April 2021. The Australian Securities and Investments Commission Act 2001 applies to insurance contracts if the insurance contract was entered into or renewed on or after 5 April 2021, or a term in an existing contract was varied on or after 5 April 2021.
