On 17 May 2024 the ACCC sent a request to ARTC to provide further information to support the assessment of the Proposed Undertaking. The 2011 Hunter Valley Coal Network Access Undertaking (HVAU) requires the Australian Rail Track Corporation (ARTC) to send documents to the ACCC for an annual compliance assessment. As part of this assessment, we examine ARTC's operating costs, including overheads.

On 28 September 2011 the ACCC accepted the 2011 Undertaking provided to the ACCC by CBH on 20 September 2011.
