The Full Federal Court today upheld the primary Federal Court judgment dismissing the Australian Competition and Consumer Commission’s application to prevent Metcash from acquiring the Franklins supermarket business.

“The ACCC will closely examine the judgment before commenting further,” ACCC chairman Rod Sims said.

The ACCC filed an appeal on Friday 9 September 2011 against the Federal Court’s judgment dismissing the ACCC’s application to prevent Metcash from acquiring the Franklins supermarket business.

The appeal was heard in Sydney in late October and judgment was handed down on Wednesday 30 November.
