The Australian Competition and Consumer Commission has issued a draft determination proposing to grant authorisation for 10 years to the Reserve Bank Health Society (RBHS) and allow another private health fund, Lysaght Peoplecare Limited, to provide RBHS with advice on operational matters under a management services agreement.

Broadly, the ACCC may grant authorisation, protection for conduct that might otherwise raise concerns under the competition provisions of the Competition and Consumer Act 2010, where it is satisfied that the public benefit arising from the conduct outweighs any public detriment.

The ACCC invites comments on the draft determination. The ACCC’s draft determination and information about making a submission will be available from the ACCC website, www.accc.gov.au/AuthorisationsRegister

Parties wishing to make submissions should do so by 10 August 2011.
