The Parliamentary Secretary to the Treasurer, Senator Ian Campbell, has today announced an eighteen month temporary ban under the Trade Practices Act 1974 on mini-cup jelly confectionery containing konjac.

Australian Competition and Consumer Commission Chairman, Professor Allan Fels, said ban would be vigorously enforced, nationally, by the ACCC.

"The mini-cup jellies, containing konjac, pose a serious choking hazard, particularly to young children and the elderly, and ACCC staff will work swiftly to ensure that the product does not remain on the market.

"There have been a substantial number of deaths and near-deaths overseas and several incidents here in Australia as well, including the death of a child in New South Wales.

"A number of countries have already banned the product and bans have also been placed under State legislation in Queensland, NSW, Victoria and the Northern Territory. Introducing a national ban under the Act will ensure that all States and Territories are covered.

"Penalties under the Act can be severe on suppliers, including retailers. The courts can impose penalties up to $1.1 million for corporations and $220,000 for individuals".
