In a draft determination released today the Australian Competition and Consumer Commission proposes to grant authorisation to a number of proposed changes to the National Electricity Code.

The changes are essential for an orderly commencement of the National Electricity Market on 15 November 1998, and include further transitional arrangements, and amendments to clarify the interpretation and application of the Code. This proposed authorisation complements the Commission's previous determination of 10 December 1997.

The development of the national electricity market is the culmination of reforms stemming from COAG decisions taken in July 1991 for the electricity industry and other micro-economic reform. The authorisation of the National Electricity Code clears the way for the establishment of the National Electricity Market, to operate in the south eastern states of Australia.

The ACCC's draft determination sets out a number of conditions of authorisation, amending the proposed Code changes. These conditions deal mainly with the transitional arrangements, some elements of the market rules, registration requirements and administrative provisions. The authorisation of the proposed changes will not take effect until the amendments to the Code required by the ACCC are in place.

The Commission now invites the applicants and other interested persons to notify it within 14 days of 11 August 1998 whether the applicants or other interested persons wish the Commission to hold a conference in relation to this draft determination.

If the applicants or an interested party notifies the Commission in writing that they want the Commission to hold a conference, the conference will be held in the Commission's office in Canberra on the afternoon of Thursday 27 August 1998.

Copies of the ACCC's determination can be obtained from Ms Maxine Helmling on telephone (02) 6243 1249 (Canberra) or ACCC state offices in all capital cities.
