Interim orders restraining the supply of an aerosol dry powder chemical type fire extinguisher, branded 'Fireout', have been brought down by the Federal Court, Melbourne.

The Australian Competition and Consumer Commission filed proceedings on 18 December 1996 in the Federal Court against Atmospherics Corporation Pty Ltd, the manufacturer of Fireout, Candy Point Pty Ltd trading as Bocam Sales, and Nuline Distributors Pty Ltd, distributors of 'Fireout'.

In an appearance in the Federal Court on Friday, the ACCC sought an interim injunction and other orders preventing the further sales of the extinguisher. The ACCC alleged that recent tests have indicated that the extinguisher fails to meet the requirements of the mandatory standard declared under section 65C of the Trade Practices Act. In particular the ACCC alleges that in recent tests the extinguisher failed to extinguish fires when tested in accordance with the requirements of the standard.

The Court ordered that Atmospherics Corporation Pty Ltd and Nuline Distributors Pty Ltd be restrained from supplying fire extinguishers branded 'Fireout'. The matter will be before the Federal Court for further directions on 4 February.
