Description of Conduct

The Australian Writers' Guild (AWG) sought revocation of its authorisation (A91274) and the substitution of a new authorisation to enable current and future members of the AWG to collectively negotiate model agreements which can be used by current and future members of the AWG when contracting with producers of film, television and digital media.

Authorisation A91274 allowed AWG members to collectively negotiate with Screen Producers Australia (SPA). The AWG sought to expand the scope of the authorisation to also include negotiations between AWG members and producers who are not members of SPA (the expanded conduct). The AWG sought authorisation for a period of 10 years.

On 28 February 2017, the ACCC granted interim authorisation to enable current and future members of the AWG to continue to collectively bargain on behalf of its members in relation to the terms and conditions of model terms of engagement with SPA for use by writers when contracting with film or television producers. Interim authorisation did not extend to negotiations between AWG members and producers who are not members of SPA.

On 31 May 2017, the ACCC released a draft determination proposing to authorise members of AWG to collectively negotiate model agreements when contracting with producers of film, television and digital media. One submission was received on the draft determination.

On 23 June 2017, the ACCC released a determination granting authorisation to current and future members of AWG to collectively negotiate model agreements, which can be used by current and future members of the AWG when contracting with producers of film, television and digital media.
