Description of Conduct

On 16 March 2005, the Canberra After Hours Locum Medical Service (CALMS) lodged an application for authorisation of a capped fee structure in its provision of after hours primary medical care in the ACT, as set out in a contract to be entered into by CALMS and ACT Health.

On 29 June 2005, the ACCC granted authorisation to CALMS to use a capped fee structure in its provision of after hours primary medical care in the ACT, as set out in principle in the contract entered into by CALMS and ACT Health and as defined in CALMS' submission and referred to in the table at paragraph 2.17 of the ACCC's final determination. Authorisation is granted until 30 June 2008 or until the contract between ACT Health and CALMS ceases to be in force, whichever occurs earlier.
