Description of Conduct
Independent Cinemas Australia Inc. (ICA) applied for authorisation on behalf of itself and current and future Australian members, on a voluntary opt out basis, to share information and collectively bargain with film distributors.
On 22 June 2017, the ACCC invited interested parties to make submissions on ICA’s application for authorisation. The ACCC considered interested party submissions before making its draft determination.
On 28 September 2017, the ACCC issued a draft determination proposing to grant authorisation for five years. Interested parties were invited to make submissions on the draft determination.
On 8 November 2017, the ACCC held a conference on the draft determination. ICA and interested parties were invited to attend the conference.
Following the conference, interested parties were invited to make submissions on the oral and/or written submissions presented at the conference. Submissions were considered by the ACCC prior to making a final determination.
On 16 March 2018, the ACCC granted authorisation to the applicants for five years.
