Description of Conduct
Mine Energy Solutions Pty Ltd proposes to enter into a master supply Agreement with Quantum Fuel Systems Technologies Worldwide to acquire a supply of custom made high pressure compressed natural gas cylinder tanks for storage of gas fuel. The proposed contract includes an agreement that Quantum will not supply the tanks to anyone else for use in vehicles or equipment for mining in certain jurisdictions including Australia (excluding vehicles which make deliveries to mines), provided Mine Energy Solutions purchases a minimum number of tanks from Quantum each year.
On 19 August 2016 the ACCC issues a determination granting authorisation to the arrangements for up to five years.
