Description of Conduct
Derogation from NSW government to replace existing derogation (clause 9.16 of the code) which gives certainty to TransGrid and Energy Australia in applying the ACCC's draft revenue cap decision dated 28 April 2004 in order to set transmission prices for the period 2004-05.
Minor variations to the code accepted - negligible detriment, and possible public benefits arising from increased certainty about legal basis for determining prices
