Description of Conduct

On 31 August 2021, the Northern Territory of Australia as represented by the Department of Health (the Department) lodged an application seeking the revocation of authorisation AA1000499 and substitution with AA1000570.

The Department on behalf of itself, specified private healthcare providers operating in the Northern Territory, and all Northern Territory public hospitals and other healthcare facilities seeks to negotiate and enter into agreements with each participating private healthcare provider, under which the Department will provide funding and those providers will provide resources and services to the overall response to COVID-19 in the Northern Territory being coordinated by the Department.

The Department also seeks authorisation on behalf of other private healthcare providers notified to the ACCC from time to time.

On 28 September 2021, the ACCC issued a draft determination proposing to grant reauthorisation and granting interim authorisation.

On 2 December 2021, the ACCC issued a final determination granting authorisation for 18 months, until 24 June 2023.
