Description of Conduct
On 16 November 2007 the ACCC received an application for authorisation from Pacific National, Queensland Rail and Port Waratah Coal Services (the Applicants) for a proposed Vessel Queue Management System (VQMS) to operate in the Hunter Valley in 2008. The proposed VQMS seeks to address the imbalance between the demand for coal haulage and loading services at the Port of Newcastle and the capacity of the Hunter Valley coal chain.
At the time of lodging the application, the Applicants requested urgent interim authorisation of the proposed VQMS so they could commence the necessary steps to implement the VQMS on 1 January 2008.
The closing dates for submissions on the request for interim and the substantive applications for authorisation were 30 November 2007 and 12 December 2007 respectively.
On 11 December 2007 the Applicants wrote to the ACCC requesting it to defer its consideration of the request for interim authorisation until 31 January 2008.
On 13 December 2007 the ACCC decided not to grant interim authorisation for the proposed VQMS at that time.
On 22 January 2008 the Applicants withdrew the applications for authorisation. As such, the ACCC will not proceed with its consideration of the proposed VQMS.
