Description of Conduct
Port of Brisbane Pty Ltd (PBPL) and Carnival sought authorisation for arrangements to support the construction of a new cruise ship terminal by PBPL, whereby the parties will enter into an agreement under which Carnival will be bound by take or pay obligations for the new terminal, in exchange for which it will receive certain preferential berthing rights from PBPL.
On 10 May 2018, the ACCC issued a final determination granting conditional authorisation until 31 May 2036.
