Description of Conduct
Southern Metropolitan Regional Council (for itself and on behalf of City of Cockburn, City of Fremantle, City of Melville and Town of East Fremantle, collectively the project participants) proposes to conduct a joint tendering process on behalf of the project participants for the disposal of their materials recovery facility to a private sector operator. The project participants and the operator will then enter into Recyclable Waste Processing Agreements on consistent terms for the long term supply of recyclable waste by the project participants to the operator and the provision of recyclable waste processing services by the operator to the project participants. The Applicabts seek authorisation for 21 years.
On 18 November 2015, the ACCC granted interim authorisation to the arrangement.
On 11 February 2016, the ACCC released a draft determination proposing to grant authorisation for 21 years.
On 23 March 2016, the ACCC released a final determination granting authorisation to the applicants for 21 years.
