Description of Conduct

TAB and Tabcorp are seeking authorisation to:
1. give effect to agreements with Premier Gateway International (PGI) ? the PGI TAB Host Agreement and the PGI
SuperTAB Host Agreement. These agreements cover PGI's participation in the TAB and SuperTAB pools. The
agreements also govern PGI's provision of interface services to overseas wagering operators seeking to participate in the
pools operated by TAB and Tabcorp.
2. give effect, or to make and give effect to arrangements between TAB and various overseas wagering operators and
Tabcorp and various overseas wagering operators in each of their respective pools. Under these arrangements TAB and
Tabcorp propose to:
a. Provide pooling services to overseas wagering operators on condition that the overseas wagering operators:
i. Obtain and maintain relevant approvals from various regulatory bodies
ii. Do not re-supply those pooling services to any other totalisator
iii. Must transmit to TAB or Tabcorp bets received by the wagering operator of the approved bet types on a Host
Nominated Race, and do not transmit such bets to other totalisators.
b. Acquire pooling services from overseas wagering operators on condition that they do not permit certain persons to comingle
into the merged pool.
TAB and Tabcorp are seeking authorisation for seven years.

On 27 August 2014, the ACCC issued a draft determination proposing to grant authorisation for 7 years to Tabcorp in relation to international pooling arrangements with PGI and overseas wagering operators to allow for the transmission of bets by overseas punters into Tabcorp totalisator pools and the transmission of bets by Australian opunters into overseas pools.

The ACCC also granted interim authorisation for Tabcorp to enter into international pooling arrangements with certain identified parties, and to give effect to those provisions.

Interim authoirsation commences immedicately and will remain in place until the date the ACCC's final determination comes into effect or until it decides to revoke interim authorisation.

On 10 September 2014, Tabcorp applied to amend the applications to include the ACT Totalisator in international pooling arrangements in the event it is successful in its acquisition of the ACTTAB business. The ACCC is currently seeking coments on the request to vary the applications. Please see the consultation letter under the ACCC correspondence link for further information.

On 29 October 2014, the ACCC granted authorisation until 20 November 2021 to Tabcorp Wagering Manager, TAB and Tabcorp ACT Pty Ltd (the entity that acquired ACTTAB's assets) to give effect, or to make and give effect, to Specified Provisions in international pooling agreements with overseas wagering operators and PGI.
