Description of Conduct
Reserve Bank Health Society Ltd (RBHS) has entered into a management services agreement with Lysaght Peoplecare Ltd (Peoplecare), a fellow provider of private health insurance, for Peoplecare to provide administrative, operational and management services to RBHS. Information flow between RBHS and Peoplecare and Peoplecare's role in advising the RBHS Board, including on setting premiums and benefits, may potentially be interepreted as cartel provisions under the Competition and Consumer Act 2010.
On 27 July 2011, the ACCC issued a draft determination proposing to grant authorisation to RBHS for the proposed arrangements for a period of 10 years.
On 25 August 2011, the ACCC issued a final determination granting authorisation to RBHS for the proposed arrangements for a period of 10 years.
