Description of Conduct
St George Region of Councils (Georges River Council and Rockdale City Council) lodged an application for revocation and substitution to extend their existing authorisation by five years to 2023. Under an existing authorisation, the Councils jointly tendered for the provision of waste and recycling collection services in 2007 and entered into contracts with SUEZ Recycling & Recovery Pty Ltd with an initial contract term of ten years. The contracts included clauses that enabled the contracts to be extended by five years. The substitute application has been lodged to enable the councils to invoke the contract extension clauses in their waste and recycling collection contracts.
On 14 September 2016, the ACCC issued a final determination granting authorisation until 2 February 2023.
