Capital Brewing Co Pty Ltd (Capital Brewing) and Bentspoke Brewing Company Pty Ltd (Bentspoke) lodged a notification of small business collective bargaining to cover a proposed joint bid (and associated collective activity) to GIO Stadium for the rights to supply beer and cider products at specified events (known as ‘pourage rights’). Capital Brewing and Bentspoke will not share pricing or rebate information as part of their joint bid.
On 9 September 2021 the ACCC decided not to object to the notification. The legal protection provided by the notification commenced on 19 August 2021 and will remain in force until 19 August 2026, unless it is withdrawn or revoked.
