Summary
AGL Energy Limited (AGL) proposes to supply, or offer to supply, or give or allow, or offering to give or allow, a discount, allowance, rebate or credit in connection with the supply or proposed supply of contractual rights, benefits or privileges to a franchisee under a franchise agreement granting the right to conduct a business under a brand owned by the AGL Group, on the condition that the franchisee acquire:
- goods of the type that, under the terms of the franchise agreement, franchisees are required to acquire for the purposes of resale from a supplier(s) nominated by AGL from time to time ; and
- goods and services of the type that, under the terms of the franchise agreement, franchisees are required to acquire for use in the franchisees' business from a supplier(s) nominated by AGL from time to time.
AGL also proposes to refuse to supply, or refuse to give or allow a discount, allowance, rebate or credit in connection with the supply of contractual rights, benefits or privileges to a franchisee under a franchise agreement granting the right to conduct a business under a brand owned by the AGL Group, for the reason that the franchisee has not acquired, or has not agreed to acquire, approved products or approved inputs from approved suppliers.
- goods of the type that, under the terms of the franchise agreement, franchisees are required to acquire for the purposes of resale from a supplier(s) nominated by AGL from time to time ; and
- goods and services of the type that, under the terms of the franchise agreement, franchisees are required to acquire for use in the franchisees' business from a supplier(s) nominated by AGL from time to time.
