Summary
Chevron Australia Downstream Fuels Pty Limited (formerly Australian Fuel Distributors Pty Limited (Ausfuel)) lodged an exclusive dealing notification with the ACCC on 20 April 2012. Ausfuel proposed to implement a system for the operation of its convenience stores which required the operator (a licensee appointed by Ausfuel) to:
- be and remain a member of the buying group(s) nominated by Ausfuel; and
- where the buying group(s) made available any of the products, and if the operator wished to buy any such products, buy those products from the buying group(s) unless the operator had Ausfuel's prior written consent to buy such products from another supplier.
