Esperance Power Station Pty Ltd (EPS) lodged a notification relaing to a Power Purchase Agreement (PPA) with Western Power Corporation (WPC). WPC is obliged to purchase all of its required electricity from EPS. Exceptions are:
(a) the PPA allows for a buy out by WPC of the PPA in certain circumstances, including technical obsolescence; and
(b) the PPA allows WPC the opportunity to buy some of its energy requirements from other suppliers and to buy down some of its capacity requirements from third parties.
