Summary
The proposed conduct concerns the distribution of Tech Cotton and involves the following:
1. Monsanto will license growers to use its patented technology on condition that:
(a) the grower sign a Technology User Agreement (TUA) with Monsanto and acquire seeds containing Monsanto's patented technology only from authorised Technology Service Providers (TSPs), and
(b) growers who elect to pay an end point royalty which is based o the yield of the Tech Cotton crop together with a set planting fee, must deliver the cotton to cotton gins authorised by Monsanto.
2. Nineteen TSPs will supply Tech Cotton seeds to growers on condition that the grower enters into a TUA with Monsanto
