Overview
The Department of Climate Change, Energy, the Environment and Water (the Department) has lodged an application to register a certification trade mark. The mark is intended to certify that a business or organisation has received Climate Active Carbon Neutral certification for reducing and offsetting its carbon dioxide emissions.
- On 8 October 2019, the Department (then known as the Department of Industry, Science, Energy and Resources) applied to IP Australia to register the trade mark.
- On 22 March 2021, the CTM Rules were provided to the ACCC for evaluation. Following engagement between the ACCC and the Department, a revised set of Rules was submitted to the ACCC on 2 December 2021, and a subsequent revised set of Rules was submitted on 30 June 2022.
- On 11 April 2023, a further revised set of Rules was submitted to the ACCC.
- On 16 June 2023, the Department requested the ACCC suspend its assessment of the CTM as the Department is currently conducting a consultation on the future direction of Climate Active, which is considering a range of issues including use of the Climate Active certification trade mark.
- The ACCC’s assessment is suspended until further notice.
