Exemption for EnergyAustralia Pty Ltd

On 20 October 2022, the Australian Competition and Consumer Commission (ACCC) granted an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth) to EnergyAustralia Pty Ltd (EnergyAustralia) deferring its consumer data sharing in respect of non-complex requests until 15 May 2023 (a 6 month delay). The ACCC granted the exemption in response to an application from EnergyAustralia. In granting the exemption the ACCC considered the factors set out in our Guidance for applicants seeking exemption under section 56GD and had regard to circumstances particular to EnergyAustralia, including the delivery of an ongoing systems upgrade program that pre-dated the CDR.
