Competition analysis

The acquisition involved primarily the ownership of the brand name Ski and the relevant intellectual property and other licencing rights. The brand name was acquired by Nestle UK. Ski is currently produced under licence, operative for a further 10 years, in Australia by Dairy Farmers and is the second largest seller. Nestle also competes in the relevant market in Australia and is the third largest seller, with National Foods as the largest.

The Commission decided not to oppose the acquisition following assurances from Nestle, amongst other things, that the current licencing arrangement will remain unchanged by the acquisition and Nestle Australia will have little involvement in overseeing the licence operation.
