Market definition

The ACCC considered the proposed acquisition in the context of the national markets for the manufacture and supply of:
- rigid plastic non-beverage containers and at its narrowest, 1-5L blow moulded bottles; and
- small industrial containers and at its narrowest, plastic pails.

Competition analysis

On 31 July 2007, the ACCC decided not to intervene in the proposed acquisition.

In relation to the parties' supply of rigid plastic non-beverage containers, the ACCC concluded that the proposed acquisition would be unlikely to result in a substantial lessening of competition.

In relation to the parties' supply of small industrial containers, the ACCC concluded that it is likely Pact Group would continue to face competitive constraints from alternate suppliers including significant plastic pail suppliers such as NCI and Viscount and potential import competition. In addition, the ACCC concluded that the proposed acquisition would be unlikely to significantly increase the ability or incentive for Pact Group to foreclose competition through bundling or tying of packaging products.
