Market definition

For the purposes of analysing the acquisition, the ACCC considered the narrowest possible product dimension, being the supply of retail space in sub-regional shopping centres, on the basis that the analysis of a wider product dimension would be likely to produce the same conclusion on whether the acquisition would contravene section 50. The ACCC considered the relevant geographic dimension to be the Albury CBD.

Competition analysis

The ACCC concluded that the acquisition was unlikely to result in a substantial lessening of competition in the relevant market primarily because Centro does not own any sub-regional shopping centres other than West End Plaza in the relevant market and, in this regard, was considered to be a new entrant.
