The ACCC formed the view that the proposed acquisition was unlikely to substantially lessen competition in any relevant markets. In reaching this view, the ACCC noted that:- the merged entity would continue to be competitively constrained by existing competitors, including Boral and Adelaide Brighton; and
- the merged entity's incentives would not be significantly altered as a result of the proposed acquisition.
