Extension of existing fixed line services and the wholesale ADSL service FADs

On 16 April 2014, the ACCC decided to extend the existing the final access determinations (FADs) for the declared fixed line services (LCS, WLR, LSS, ULLS, PSTN OA (FOAS as of 1 August 2014), PSTN TA (FTAS as of August 1 2014) and the wholesale ADSL service. The ACCC is extending these FADs as it will not be in a position to make the new fixed line services and the wholesale ADSL service FADs prior to their expiration.

The existing declared fixed line services FADs and the wholesale ADSL service FAD are set to expire on 30 June 2014.

Determination

The fixed line services final access determinations (FADs) were varied on 14 December 2011 to remove geographic exemptions from standard access obligations in respect of WLR, LCS and PSTN OA. The FADs were varied a second time on 27 June 2012 to temporarily remove the application of the standard access obligations in respect of WLR, LCS and PSTN OA (preselect and override) services provided over the National Broadband Network.  In accordance with clause 4.1B of the FADs, clause 4.1A of the FADs expired on 7 December 2012. Four of the existing FADs were varied further on 18 June 2014. These variations are to the LCS and WLR service FADs so as to include price and non-price terms for the supply these declared services in central business district (CBD) areas from 1 August 2014; and to the ULLS and LSS FADs to include a regulated charge in respect of the internal interconnection cable (IIC) used in connection with the ULLS and LSS.
