Anythoughts Pty Ltd (formerly Votel Pty Ltd) - s.87B undertaking

Contravention of Ss52, 53(e), 53(g) and 53C of the Trade Practices Act. Anythoughts broadcast three TV ads on Channel 10 in WA promoting Nortel 911, Nokia 3810 and Motorola Startac 70 mobile phones and service packages. The advertisements were too small in size, appeared too briefly, lacked connection to the product and price info. Further, the ads did not include the cash price when part of the payment for the packages was advertised. Anythoughts gives the following undertakings to the ACCC: it will not engage in misleading/deceptive representations about the price of gds or svcs or packages of gds and svcs advertised, or about the conditions which these are available for purchase; it will specify the cash price of these gds/svcs and packages; broadcast a corrective notice to Channel 10; it will also undertake a Trade Practices Corporate Compliance Program.
