Australasian Institute Pty Ltd - s.87B undertaking

The Australasian Institute Pty Limited ('TAI') operates as a provider/deliverer of various educational courses over the internet.

In early 1999, TAI published or caused to be published various representations, regarding educational courses offered and/or delivered by TAI, in the print media and on its website. Following a complaint regarding the accuracy of these claims and the operations of TAI in general, the Commission commenced an investigation into the operations of TAI. As a result of these investigations, the Commission instituted proceedings in the Federal Court of Australia against TAI alleging breaches of, inter alia, sections 52, 53c and 55A.

This matter was subsequently referred to mediation by Justice Madgwick. Ultimately, TAI and the Commission reached an in-principle agreement to settle these proceedings. In addition, the Directors of TAI undertook to attend a seminar, as agreed between the parties, conducted by a person suitably qualified, on trade practices law to ensure future compliance with Part V of the Act within 6 months of the date of the undertaking.
