Korab & Co Pty Ltd - s.87B undertaking

The Commission alleges that in supplying various CSIRO documents Korab: (i) engaged in conduct that is misleading or deceptive or likely to be misleading or deceptive in contravention of s52 of the Trade Practices Act; (ii) falsely represented that goods had an approval which they did not in fact possess in contravention of section 53(c) of the Act. In light of this, Korab has agreed to a number of undertakings. These include a letter (and questionnaire) to all customers to whom Korab supplied either fire door components or other fire safety related products, identified from its sales records dating back to March 1996. It also undertakes to appoint an independent Auditor to assess the returned customer questionnaires to ascertain whether Korab has acted upon the outcome or contents of the questionnaire. They also undertake to institute a Trade Practices Corporate Compliance Program.
