Sherpa Outdoor Equipment Pty Ltd (Sherpa) incorrectly labelled their Polytherm range of thermal underwear as a composition of Polypropylene and Spandex. The actual garments were labelled 95% Polypropylene and 5% Spandex. The representations appeared on both the garment and the packaging of the product. Sherpa confirmed that the garments were actually composed of 95% Acrylic and 5% Spandex.

The undertaking provides for the garments to be relabelled re composition and possibly care instructions, the removal of garments from current packaging or alternatively oversticking be applied to any representation as to composition and performance characteristics; the placement of a corrective advertisement; refunds to consumers and the institution of a compliance program.
