Stamford Hotels Pty Ltd - s.87B undertaking

Stamford Hotels Pty Ltd (Stamford Hotels) is the owner and operator of the Stamford Grand North Ryde (the Hotel).

In April 2008, then General Manager of the Hotel, Mr Bruce McLean, allegedly made a misleading representation to a guest of the Hotel that the advertising of Stamford Hotels had clearance from the ACCC.

Stamford Hotels has acknowledged that the ACCC does not clear the advertising of traders as part of its functions and has admitted that it has contravened section 52 of the Trade Practices Act 1974 through the representation made by Mr McLean.

Stamford Hotels has provided the ACCC with a court enforceable undertaking that it will:

• not make any representation, either orally or in writing, to the effect that its advertising has ACCC approval when this is not the case;
• send a letter of correction and apology to the affected guest;
• publish a corrective notice in the reception area of the Stamford Grand North Ryde Hotel; and
• implement a Trade Practices Compliance Program.
