Undertaking
This matter concerned allegations of false or misleading representations and unconscionable conduct in connection with the sale and marketing of a computer software betting program in Australia and New Zealand by Solutions Software International Pty Ltd and the companies formerly known as Acepark Pty Ltd and Offtrack Investments Pty Ltd. The program was marketed under names such as "Autotab", "Offtrack" and "Solutions Software".
On 3 September 2002, Justice Dowsett of the Federal Court, Brisbane made default Judgment against the corporate respondents in the form of declarations, findings of fact, permanent injunctions and costs. The Court found that Mr Robert James Price was knowingly concerned in contraventions of the Trade Practices Act.
On 2 September 2002 Justice Dowsett made orders (by consent) against two of Mr Price's former colleagues Ronald James Curtin and William Greig Millar in the form of permanent injunctions and their attendance at a trade practices compliance seminar. The Court noted that Mr Millar provided the Commission with a Section 87B Undertaking under which he is required to undertake 72 hours community service with a gambling support organisation on the Gold Coast by no later than six (6) months from the date of the orders.
