About this register
This register is a record of all Consumer Data Right exemptions granted by the ACCC.
The Consumer Data Right is a world-leading data sharing and portability initiative that:
- allows consumers to safely share the data that businesses hold about them with accredited third parties
- helps consumers compare between products and services to find offers that best match their needs, and
- encourages competition between providers, leading to more innovative products and services.
The ACCC has a broad discretionary power under section 56GD of the Competition and Consumer Act 2010 to exempt a person from the Consumer Data Right regime. This includes:
- provisions in Part IVD in the Competition and Consumer Act 2010
- regulations made for the purposes of Part IVD, and
- the consumer data rules.
Each exemption application is assessed on a case-by-case basis. An exemption may or may not be time limited and can be subject to conditions. The ACCC cannot retrospectively grant an exemption for conduct that has occurred.

On 18 April 2024, the Australian Competition and Consumer Commission (ACCC) granted an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth) to Beyond Bank Australia Limited deferring its consumer data sharing obligations in respect of the AWA Alliance Bank brand until 31 December 2024.
On 18 April 2024, the Australian Competition and Consumer Commission (ACCC) granted an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth) to EnergyAustralia Pty Ltd (EnergyAustralia) deferring its consumer data sharing obligations for its Battery Ease trial until 31 December 2025.
On 4 April 2024, the Australian Competition and Consumer Commission (ACCC) granted an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth) to Amber Electric Pty Ltd deferring its obligations to share consumer data in respect of complex and non-complex requests until 31 March 2025.
On 21 March 2024, the Australian Competition and Consumer Commission (ACCC) granted an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth) to Avenue Bank Limited deferring its product reference data and consumer data sharing obligations until 31 July 2025.
On 22 February 2024, the Australian Competition and Consumer Commission (ACCC) granted an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth) to Bank of Queensland Limited (BOQ) from certain obligations under the CDR Rules in respect of sharing consumer data held on the ME Bank legacy platforms relating to customers that have been migrated to BOQ’s cloud-based digital retail banking platform. The ACCC granted the exemption in response to an application from BOQ.
On 14 December 2023, the Australian Competition and Consumer Commission (ACCC) granted a time-limited, conditional exemption under section 56GD of the Competition and Consumer Act 2010 (Cth) to Heritage and People’s Choice Limited (HPCL) deferring certain obligations (as specified in the exemption instrument) in respect of the cohort of consumers that have products with both the Heritage Bank and People’s Choice brands, but only meet the CDR consumer eligibility criteria with respect to one of those brands until 30 April 2026.
On 14 December 2023, the Australian Competition and Consumer Commission (ACCC) granted an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth) to Liberty Financial Pty Ltd deferring its obligations to disclose its product and consumer data until 1 July 2024.
On 14 December 2023, the Australian Competition and Consumer Commission (ACCC) granted an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth) (the Act) to Bendigo and Adelaide Bank Limited (BABL) deferring certain consumer data sharing obligations in relation to its Rural Bank brand until 30 November 2024, and in relation to its Adelaide Bank brand until 30 June 2024 for new and refinanced brokered customers and until 31 December 2025 for existing brokered customers and white-labelled products.
On 14 December 2023, the Australian Competition and Consumer Commission (ACCC) granted an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth) to National Australia Bank Limited (NAB) deferring its consumer data sharing obligations until 26 February 2026, for Citi-branded mortgage and deposit accounts closed between 1 April 2022 and 25 February 2024 held by individuals, non-individuals and partnerships (including joint accounts).
On 16 November 2023, the Australian Competition and Consumer Commission (ACCC) granted an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth) (the Act) to Alex Bank deferring certain consumer data sharing obligations under the CDR Rules (as specified in the exemption instrument) until 31 December 2024.
On 16 November 2023, the Australian Competition and Consumer Commission (ACCC) granted an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth), to Credit Union Australia Ltd (trading as Great Southern Bank) (GSB) deferring its product data and consumer data sharing obligations for its pilot digital business banking platform until 30 June 2024.
On 5 October 2023, the Australian Competition and Consumer Commission (ACCC) granted 1st Energy Pty Ltd an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth) from specific data sharing obligations under Part 1 and Part 4 of the CDR Rules as specified in the exemption instrument, until 10 May 2024.
On 5 October 2023, the Australian Competition and Consumer Commission (ACCC) granted an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth) to Newcastle Greater Mutual Group Ltd deferring certain consumer data sharing obligations under the CDR Rules (as specified in the exemption instrument) in relation to the Greater Bank brand until 30 November 2024.
On 21 September 2023, the Australian Competition and Consumer Commission (ACCC) granted an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth), to PayPal Australia Pty Ltd (PayPal) in relation to its obligations under the CDR Rules to provide multiple account selection functionality for business accounts which are bundled with its Enterprise View interface, and its obligations under the CDR Rules to share consumer data for closed accounts that were previously bundled with its Enterprise View interface until 21 September 2028.
On 7 September 2023, the Australian Competition and Consumer Commission (ACCC) granted an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth) to Bank of Queensland Limited (BOQ) deferring certain product reference data and consumer data sharing obligations under the CDR Rules (as specified in the exemption instrument) in respect of all accounts it issues in relation to StrataCash Management Pty Ltd until 7 September 2028.
On 7 September 2023, the Australian Competition and Consumer Commission (ACCC) granted Discover Energy Pty Ltd (Discover Energy) an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth) from specific consumer data sharing obligations under Part 1 and all of Part 4 of the Competition and Consumer (Consumer Data Right) Rules 2020 (CDR Rules).
On 25 August 2023, the Australian Competition and Consumer Commission (ACCC) granted an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth) to Ergon Energy Queensland Pty Ltd (EEQ) deferring certain obligations under the CDR Rules (as specified in the exemption instrument) in respect of non-complex and complex requests until 1 July 2024.
On 10 August 2023, the Australian Competition and Consumer Commission (ACCC) granted an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth) to Challenger Bank Limited deferring its consumer data sharing obligations in respect of certain reverse mortgages until 31 October 2025.
On 29 June 2023, the Australian Competition and Consumer Commission (ACCC) granted an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth), to Blue NRG Pty Ltd (Blue NRG) deferring its consumer data sharing obligations in respect of non-complex requests until 1 May 2024.
On 29 June 2023, the Australian Competition and Consumer Commission (ACCC) granted an exemption under section 56GD of the Competition and Consumer Act 2010 (Cth) to in1bank Limited (in1bank) deferring its product reference data and consumer data sharing obligations until 25 November 2024.
