The ACCC has issued two draft determinations proposing to grant authorisation to allow retail tenants to collectively bargain with their landlords.

The Australian Retailers Association, and the National Retail Association (NRA) and participating industry associations each requested authorisation to enable their tenant members who have been adversely affected by the COVID‑19 pandemic to collectively negotiate with landlords regarding the support to be provided to tenants by landlords. The NRA authorisation also permits NRA landlord members to coordinate the provision of rent relief to their small and medium enterprises tenants.

The ACCC previously granted interim authorisation to enable the collective bargaining to commence immediately. The draft determinations re-issue the interim authorisations with some additional clarifications.
