The Australian Competition and Consumer Commission has instituted civil Federal Court proceedings against Belic Tools & Machinery Pty Ltd for alleged breaches of the prescribed consumer product safety standards for vehicle and trolley jacks under section 65C of the Trade Practices Act.

Belic, a Melbourne-based supplier and retailer of tools and machinery, is alleged to have supplied the vehicle and trolley jacks at both retail and wholesale levels during 1997.

It is alleged that the vehicle jack subject to proceedings had base and head cap dimensions less than those required by the Australian mandatory standard, and that the trolley jacks stated capacity was over-stated by approximately 300 kg.

It is further alleged that both the vehicle and trolley jacks did not have the markings and operating instructions required by the relevant mandatory Australian standards for such products.

The ACCC is concerned that the alleged breaches give rise to serious safety issues and is seeking recall orders for both jacks. It is also seeking orders that the company commence a trade practices corporate compliance program with an emphasis on complying with mandatory consumer product safety standards.
