The Australian Competition and Consumer Commission is investigating a number of allegations of anti-competitive behaviour in the Australian domestic aviation industry in recent months relating to the section 46 misuse of market power provisions of the Trade Practices Act 1974.

“It seems sensible, given the breadth of the specific complaints to extend the investigations into wider analysis of possible anti-competitive conduct in the aviation industry”, ACCC Chairman, Professor Allan Fels, announced today.

“We will also approach interested parties seeking submissions into whether it may be appropriate for the ACCC to consider developing guidelines in relation to anti-competitive conduct in aviation.” Professor Fels said.

Professor Fels stated that the ACCC is committed to ensuring that the Australian aviation industry remains competitive and the benefits of fair competition are maintained and enhanced.
