Description of Conduct
The Australian Nurserymen's Fruit Improvement Company Limited (ANFIC) is a company comprising 12 nursery members that breed different fruit types for supply to growers. Broadly, the arrangements for which authorisation is sought involve a strategic alliance between ANFIC and a group of fruit growers to develop, grow and market fruit classified as `exceptional fruit' by ANFIC.
On 7 June 2006, the ACCC issued a final determination denying authorisation to the proposed arrangements. The ACCC formed the view that the arrangments were likely to lead to some anti-competitive detriment through losses in dynamic and allocative efficiency.
