Description of Conduct

On 30 November 2022, Bayside Council and Georges River Council (the Applicants) applied for authorisation to carry out a joint tender process and to enter into contracts to procure waste and recycling services (the Proposed Conduct). The Applicants (under previous names) previously received ACCC authorisation for similar conduct which was due to expire on 2 February 2023. The Applicants contend that the conduct will provide a number of public benefits, including efficiencies and cost savings, improved service quality, increased value for ratepayers and improved environmental outcomes.

The ACCC granted interim authorisation on 1 February 2023 to enable the Applicants to commence their joint tender arrangements.

On 29 March 2023, the ACCC issued a final determination granting authorisation AA1000631 until 20 April 2038.
