Black & Decker (Australia) Pty Ltd - s.87B undertaking

Black & Decker (Australia) Pty Ltd markets and distributes a range of sanders for home use. Four types of sanding discs designed for use with Black & Decker's multi-sander and detail sander products were sold with packaging with the representation that the discs were Made in Australia when they were actually imported.

Black & Decker admitted the conduct and the potential contravention of ss. 52, 53(a), 53(eb) and 55 of the TPA. Black & Decker has provided a court enforceable undertaking to the ACCC that it will:

• refrain from making false or misleading representations in relation to the place of origin, particular history and manufacturing process of its products;
• take remedial action in relation to stock already held by resellers; and
• implement and maintain a trade practices compliance program to ensure its future conduct does not contravene the TPA.
