Sections 13.3 and 13.5 of the Hunter Valley Access Undertaking (HVAU) require ARTC to prepare options for, and consult in relation to, the development of a positive performance incentive scheme (PPIS).

ARTC published its consultation document in February 2015, inviting stakeholder comments over a six week period. This process closed on 20 March 2015. There was a limited response to ARTC's consultation process.

In ARTC's report to the ACCC (received 25 June 2015), ARTC concluded 'there is little support at present for a PPIS in the form proposed by ARTC at this time' and that stakeholders were of the view that ‘the matter should be considered as part of’ the development of the 2016 HVAU.

As a result, ARTC has decided not to submit an amendment to the 2011 HVAU to incorporate a PPIS at this time. The PPIS will instead be included in the replacement access undertaking being developed by ARTC over 2015-16.
