Replacement variation request submitted20 Dec 2021

On 20 December 2021 Telstra submitted a replacement of its August 2021 Migration Plan variation proposal.

Following industry feedback regarding Telstra’s August 2021 proposal, Telstra proposed that an in-train order (ITO) arrangement would apply to the disconnection of Multi Dwelling Unit Common Area and fire and lift telephone services.

The changes to the Migration Plan proposed by Telstra in August 2021 (published by the ACCC on 22 September 2021) regarding not NBN-serviceable premises, payphone definitions and Telstra authorised persons were unamended in its revised proposal.

Telstra’s submission and a marked-up version of the varied Migration Plan as proposed are available below.

The ACCC was required to consult publicly on the proposal and consider whether the amended variation proposal complies with the Migration Plan Principles.

Submissions were due by 28 January 2022 and the ACCC received one submission, available below.

Under subsection 577BF(3) of the Telecommunications Act 1997 the ACCC must approve the variation if it is satisfied that the final Migration Plan as varied complies with the Migration Plan Principles or otherwise refuse to approve the variation.

The ACCC approved the variation on 23 February 2022.
