On 30 October 2007 the ACCC issued a discussion paper on Telstra’s exemption applications. Written submissions in response to the discussion paper were requested by 14 December 2007.

Submissions

Telstra has stated that it will not be providing public versions of the revised Annexure I, revised explanatory statement to Annexure I or further Telstra employee witness statement, as the extent of masking is so extensive that the public versions are of no assistance. Telstra has stated that it is prepared to provide confidential versions of the submission and all attachments and annexures to people who sign confidentiality undertakings in an appropriate form.

Optus confidentiality undertaking

Optus provided the ACCC with a confidential version of its submission and two confidential appendices. Optus is prepared to provide this confidential submission and the confidential appendices to parties who sign a confidentiality undertaking. This confidentiality undertaking is provided below. Parties wishing to gain access to Optus' confidential submission and confidential appendices should complete the confidentiality undertaking and send it to Carolyn Yan at carolyn.yan@optus.com.au, copied to Sarah Sheppard at sarah.sheppard@accc.gov.au.

If Optus does not agree to provide an interested party with Optus' confidential submission and confidential appendices, then that party should advise the ACCC of this. The ACCC will then act to resolve the dispute.
