Sunwater Limited: Decisions under Part 6 of the Water Charge Rules 2010

On 27 October 2021, the ACCC formed the view that Sunwater is a Part 6 operator under the Water Charge Rules 2010 (WCR).

The ACCC formed this view on the basis that Sunwater is an infrastructure operator in the Murray-Darling Basin that:

• is not required to have all of its infrastructure charges determined or approved by a single State Agency under a law of the State in a way that is consistent with subrule 29(2)(b) of the WCR; and
• levies an infrastructure charge in relation to a bulk water service in respect of water access rights.
