On 3 September 2021, Port of Portland Pty Limited applied to the ACCC to be determined an exempt service provider of port terminal services at its port terminal facility at Portland, Victoria.
On 29 October 2021, the ACCC released an issues paper to begin a public consultation process on the application submitted by Port of Portland Pty Limited. The closing date for submissions was 26 November 2021. Two submissions were received.
On 9 February 2021, the ACCC released a draft determination proposing to exempt Port of Portland Pty Limited from its Portland facility. The closing date for submissions was 9 March 2022. One submission was received.
On 3 May 2022 the ACCC released a final determination document confirming that it has determined Port of Portland Pty Limited to be an exempt service provider of port terminal services at its Portland facility. The exemption was made by notifiable instrument.
